TERMS OF SERVICE

These Terms of Service are relevant to commission projects only and are subject to revisions, editing, and additions without notice. Any article that displays an asterisk(*) is relevant to YCH’s, Customs, and/or Adoptable designs.


1) Displayed base prices are subject to change according to the complexity, difficulty, size, and medium of each individual piece.

2) Clear and concise visual references and/or descriptions of a commission idea must be provided by the Client. After which a preliminary quote will be provided by the Artist. Failure to provide clear and concise references and/or descriptions will result in commission cancellation.

3)* Payments must be made in full within 24 hours of receiving the invoice before any work is done. If full payment is not received within 24 hours, the commissioner will get a reminder, if full payment is not received in another 24 hours after the reminder was given, the commission will be canceled and refunds will not be available (only to those who paid half up front). Once full payment has cleared, the Client's commission will be added to the Artist's work queue.

4)* Payments are accepted in USD through Paypal if the artist accepts. The artist will not accept payment in any other form, unless stated otherwise.

5) Client will have the opportunity to direct alterations of the work during the sketch/thumbnail stage, and again at the flat color stage. Requested revisions that diverge from the Client's original commission description/references may increase the length of time a commission takes and will be billed separately. Revisions/edits will not be accepted once the coloring stage has been completed.

6) Critiques and redline corrections for commissions above $60 are welcomed to ensure the best result. Commissions under $40 are considered small works, thus revised sketches are not factored into the price.

7) The Artist reserves the right to reject critique and redline pertaining to artistic skill or style preference (i.e. anatomy, coloring style, etc.) or if said critique reduces the artistic quality of the piece.
 
8)* No refunds unless the Artist deems it necessary. Refunds are available to clients when the Artist cannot complete the commissioned piece due to personal issues. Clients will have the option to take a full refund, or a voucher for the amount of the original commission to be used on another date. Please contact the Artist for more information.

9) The Artist reserves the right to cancel a commission due to poor communication, rude or inappropriate behavior, or inability to communicate in clear/effective English, or unforeseen inability to complete the commission. 

10) Communications about commissions between the client and Artist will take place through Deviantart notes/chat or Discord (Viisrah#0836) for the purpose of record-keeping and consolidation. Screenshots may be taken and documented by the Artist.

11) The Artist ensures the Client will receive updates on commission when necessary. Clients are encouraged to check in when they feel it's necessary for updates, assurance, reminders, or questions. Public updates will not be made.

12) The artist will not handle the depiction of illegal activities, sexually explicit (x-rated) materials, hateful images, or trademarked characters without permission from the trademark holder. Artistic nudity, violence, and gore will be considered on a case-by-case basis. The Artist reserves the right to reject any commission for any reason. Some exceptions can be made, please contact if you have questions.

13) The Artist retains the right to display all commissioned work on any personal website, gallery, or journal. If the commissioned work is a time-sensitive gift the Artist may delay public showcase at the request of the Client.

14) The Artist retains ALL the rights to the commissioned artwork, including the right to make prints and merchandise and to alter the commissioned work to make it more generic for print at the Artist’s discretion. Image rights can be negotiated for an added fee.

15)* The Client retains all rights to their respective characters. This does not allow them the rights to the commissioned image (see articles 13 and 14).

16) The Client may NOT profit from the artwork beyond the resale of a physical original painting or drawing (traditional media, not digital). This includes the sale of the digital files or rights to the image.

17) The Client may create up to three prints for personal use (display in their home or as gifts). Client may also resize or crop the artwork to create icons, wallpapers, or other graphics to be used in non-commercial digital format, but the Client cannot alter the artwork itself. The Client may also upload the artwork to their personal website or gallery accompanied by a credit line to the Artist, and it must not be any high resolution or unwatermarked version of the artwork.

18) The Artist may recycle sketches and preparatory works rejected by the Commissioner for other commissions or personal works.

19)* In the event that a client is unreachable by ordinary contact means (email, note, chat, or other means) for 2 weeks or more, the Artist reserves the right to cancel the commission.The client is welcome to recommission the Artist at their current rate, however, the client will be pushed to the back of the queue.

20) The Artist is not responsible for lost or damaged items sent by mail.

21)* This Artist will NOT create works with Humans, Degrading themes, Religion, Politics, Fetishes, or any discriminatory themes. This Artist will most likely decline commissions for the following: Hate art, overly complex characters, Copyrighted characters, and Mecha/Robots/Machinery.

The following terms are regarding custom commissions

22) The Artist requires a clear and concise description of the Clients desired design (such as colors, species, gender identity, injuries, etc.) in the form of a mood board or inspiration form.

23) The Client may request edits to the design at any time before the finalizing stage of the custom. After the finalizing stage has been started, any other edits may be requested by the client for an added fee for each request. Edits are limited.

24) Once the custom has been completed, all rights to that character go to the client (see Article 15).

25) The Artist may use previous versions of any custom design as inspiration for future works. 

26) If the custom is of an original species (Kebanzu, Khorvis, Woolyne, Owline, etc.) there must be explicit permissions in the form of direct permission from the species owner OR as stated in official species rules and regulations. The client is to provide proof of permission before the Artist can accept the commission. This Artist in not accountable for rules broken for any species.

27)* The Client must read, understand and agree to all the above terms before entering into an agreement with the Artist. By sending payment, the Client agrees to the above terms.
